Privacy Policy

Privacy Policy

Your use of any products, services, content, features, technologies, or functions, as well as any associated websites, mobile apps, mobile sites, or other online platforms or applications that we provide to you (collectively, the "Services/Platform"), is covered by this privacy policy. To keep NearByExpire.com and its affiliate websites safe, we gather, use, and exchange personal information (details below).
Your personal information is gathered by NearByExpire.com, working both directly and through its subsidiaries. This policy goes into effect on January 1, 2026.
Clearly, information provided on NearByExpire.com is accessible to the general public. Mumbai, India, is home to our servers. Therefore, you agree to the transfer and storage of your personal information on our servers if you decide to give it to us.

1. What information do we gather about you?

1.1. Information obtained through direct communication

1.1.1. Information about registration and other accounts

We may gather the following data about you when you register to use our services:

• Your mobile number is collected if you register using it.

You may choose to provide the following extra personal information, depending on the decisions you make while logging in to or using our services:

Your Name

  • E-mail Address
  • Mobile number
  • Your credit card/debit card details in case you choose to purchase our paid services

1.1.2. Verification of your account

We employ WhatsApp verification to verify that each NearByExpire.com user's account is linked to an actual, distinct individual. Once you post an ad listing, act on an ad listing, or start a transaction, this validation process is started. We will send a WhatsApp message to a working mobile number you have supplied in order to verify your account. There is no cost associated with this procedure.

Your account will stay active, and you will have limited access to our services if you refuse to validate it. This restricted account capability means that unless your account is validated by a WhatsApp message, you are unable to publish new ad listings or edit, update, promote, extend, reactivate, deactivate, or remove current ad listings. Additionally, you won't be able to react to or receive messages from other users.

If you use the same cell number to establish multiple accounts and authenticate each one using WhatsApp verification, each of those accounts will have limited functionality, and you will be prompted to select one. Your selected account will be fully functioning again, while the other accounts will only be partially functional.

Your account will continue to be linked to the mobile number used for the WhatsApp verification once you have verified it. You must get in touch with our customer support staff if you want to modify the cellphone number linked to your account.

1.1.3. Using our platform's chat function to communicate

We gather information that you choose to share with other users when you use our chat function to interact with them.

1.2. Information we automatically gather when you utilise our services

We automatically gather the following data about you when you use our services:
We gather device-specific data, including IMEI numbers, operating system versions, unique identifiers, and standard browser log data. For instance, the name of the cell network you are connected to. The device IDs are linked to your account.

1.2.1 Details of the Device

To improve your experience, we might need access to additional applications that are installed on the device. You can utilise our services with restricted functionality if you decide not to enable access to such apps.

1.2.2. Details about the location

When you post something on our platform, we automatically gather and handle information about your real location, depending on the permissions on your device. IP addresses, GPS, Wi-Fi access points, and cell towers are just a few of the technologies we employ to pinpoint our location. You may publish items inside your area and view user items nearby thanks to your location data. If we require your location information, we will first display a pop-up window asking you to decide whether or not to grant us access to it. You will still be able to use our services, but with less functionality, if you refuse to give us access to your location data.

1.2.3. Data from clients and logs

Technical information, such as your device's operating system, time zone, and Internet Protocol (IP) address. Additionally, we will keep track of your browser type and version as well as your login details, including the date of your registration, the date of your most recent password change, and the date of your most recent successful login.

1.2.4. Clickstream information

We gather data about what you do on our platform, including
1.2.4.1. The websites from which you accessed our platform, the time and date of each visit, the searches you conducted, the listings or advertisement banners you clicked, how you interacted with them, the length of your visit, and the sequence in which you viewed the content on our platform.
1.2.4.2. Computer sign-on information, page view statistics, traffic to and from NearByExpire.com, and ad data (all via cookies; you can disable cookies on your browser, though this will probably make it harder for you to use the site); Google advertising ID on Android apps, which is a distinct, user-resettable ID for advertising provided by Google Play services

1.2.5. Cookies and Related Technologies

Cookies are used by us to store your selected language, manage user sessions, and show you relevant ads. Cookies are little text files that are sent to your device's hard drive from a web server. Cookies may be used to gather your login, browsing history, preferences, and the date and time of your visit. Your browser can be configured to reject all or certain cookies or to notify you when a website sets or uses cookies. Please be aware that certain features of our services and platform may become unavailable or malfunction if you reject or disable cookies.

2. Why do we handle your personal data?

Your personal information will only be used when permitted by law. We will often utilise your personal information in the following situations:

• If we must fulfil the terms of the contract we have or are going to enter into with you.

• To meet our business requirements, we exchange information with our business partners.

• Where our legitimate interests need it to enhance our services and provide you with a safe and secure platform.

• In situations when we must adhere to a legal or regulatory requirement.

In certain cases, we could additionally handle your personal information with your permission. If we do this, when we ask for your approval, we will inform you of the reason and kind of personal data that will be processed.

The reasons we utilise your personal information and the legal justifications we employ are explained below. Where applicable, we have also determined what our legitimate interests are.

2.1. For making our platform accessible and offering services

2.1.1. We utilise your first and last name, cellphone number, and/or email address to identify you as a user and provide you access to our Platform if you log in with these details.

2.1.2. Except for Apple ID and Truecaller, we use your first and last name from your Facebook profile and your Facebook email address to identify you as a user on our platform and to grant you access to it. If you log in using your Google account, Facebook account, Apple ID, or Truecaller account, we also use your email address and the URL to your profile picture.

2.1.3. Any payments you make to our services are processed by third-party payment service providers. You could be asked for your credit card information and payment details, depending on the method of payment. We will then provide these data to the payment service provider so they can complete your payment. Unless you elect to remember your credit card information so that you may facilitate repeated payments without having to input your information again, we do not keep your credit card information on file. In these situations, we simply save your cardholder name, card type, expiration date, and the last four card number digits. We just provide your credit card number and the credit card code verification values in an encrypted format so that our payment service provider can process your payment; we don't keep any of these.

In order to properly fulfil our agreement with you, we process the aforementioned data.

2.1.4. Metadata and other data linked to other files on your mobile device are accessed by NearByExpire.com. Photographs, audio and video clips, personal connections, and address book data will all be included. If you give NearByExpire.com access to your device's address book, we may gather names and contact details from your address book and share them with telecom companies for marketing purposes, to facilitate social interactions through our services, and for other purposes specified in this policy or at the time of consent or collection. To make sure that third parties follow our privacy policies, regulations, and guidelines, we make a good-faith effort.

We have put in place the organisational and technological safeguards required to protect your personal information, and all of the information we receive about you is kept on secure servers.

2. Two. For enhancing your Platform experience and creating new features for the Platform

2.2.1. Clickstream data is used to:

• Provide you with personalised content, such as more relevant search results when you use our services.

• To ascertain the amount of time you spend on our platform and the way you use it to identify your interests and use that information to enhance our services. For instance, depending on the material you clicked on, we could recommend other stuff for you to see.

• To share marketing and promotional offers, track and report campaign delivery performance to our business partners, and do internal business analysis.

2.2.2. If you decide to provide us with your location information, we utilise it for the following reasons:

• To gather anonymous and aggregated data on user traits and behaviour, including for segmentation, business analysis, and the creation of anonymous profiles.

• To improve our services' functionality and tailor the material we provide to you. For instance, to enhance your purchasing experience, we use location data to show ad listings that are nearby. Google Maps is included in our platform for this reason. This implies that the processing of your location data within the framework of Google Maps is the responsibility of both Google and us. In any event, we will only use your location information for the reasons listed in this Privacy Statement. However, as detailed in the Google Privacy Policy, which is available for inspection, Google may use such location data for its own objectives. Google Maps' Terms of Service govern how you use the service via our platform.

• To track and assess how you engage with the banners for third-party advertisements that we display on our platform.

2.2.3. We map the various devices (such as desktop, mobile, and tablet) that you use to access our platform using your account information, which includes your phone number and email address. This helps us provide you with a smooth experience regardless of the device you use by enabling us to link your actions on our platform across devices.

2.2.4. To improve the identification and presentation of ad listings, enhance the search function, boost the possibility of a successful sale, and personalise search results based on ad ranking and user interest, we train machine learning models using the images, descriptions, and prices you enter in your ad listings. This aids us in enhancing our offerings and giving you a better user experience.

2.2.5. We utilise algorithms that use information about your browsing habits, the things you have purchased, clickstream data, your user ID, and, if you have given us permission, your location data to display and suggest ad listings on our services that could be of interest to you. We use this kind of automated decision-making because we really want to enhance our services and provide you with a better user experience by presenting you with more relevant ad listings.

2.2.6. For the purpose of improving our products and giving you a better user experience, we access and analyse the chat messages you exchange with other users via our platform's chat feature (e.g., to detect sold goods and to present you with active listings only). In order to automatically analyse the content of your chats, we create and train machine learning models and algorithms. Our machine learning experts may manually examine example conversation material in order to develop and train our machine learning models. Certain machine learning experts who are analysing the conversation material are subject to very limited access restrictions in certain situations. We are using a scanning filter to identify and conceal personal information like names, phone numbers, and email addresses in order to de-identify chat material as much as possible. Nevertheless, there could still be situations beyond our control when the chat content displays specific personal information that you have chosen to share.

We process the aforementioned data in order to fulfil our contractual obligations to you and because we have a reasonable desire to enhance your use of our services.

2.3. to solicit your opinions, advertise, and provide you with services that could be of interest

2.3.1. To manage and safeguard our Platform (including troubleshooting, data analysis, testing, fraud protection, system maintenance, support, reporting, and data storage), we utilise your mobile number, log data, and unique device identifiers.

2.3.2. For customer satisfaction, security, and fraud prevention (e.g., to prohibit spam or abusive messages that may have been sent to you by other users), we access and analyse the chat messages you exchange with other users using our services' chat feature. In order to automatically identify and stop improper and fraudulent user behaviour, we create and train machine learning models and algorithms. We anonymise user-assigned unique identification numbers in order to de-identify chat information as much as feasible throughout the analysis and training process. Nevertheless, there could still be situations beyond our control when the chat content displays specific personal information that you have chosen to share. Our customer safety and security experts personally examine chat messages only in certain situations, such as when we have compelling evidence that raises an immediate suspicion of fraudulent activity. Selected customer safety and security experts who are analysing the conversation material are subject to very limited access permissions in these situations.

2.3.3. We utilise algorithms that identify suspect or fraudulent user behaviour based on specific facts, such as user activity and uploaded material, to mediate disputes and prevent and detect fraud on our services. These algorithms may result in the banning of certain user accounts. When there is a high level of assurance that an account or behaviour is fake, automated banning takes place. Otherwise, consumer safety and security experts are chosen by human assessment based on very limited access privileges. Based on our legitimate interest in identifying and stopping fraud and protecting our users' safety and security, we use this kind of automated decision-making. Contacting our customer support staff will allow them to evaluate the decision to ban your account if you believe it was made incorrectly.

2.3.4. Because we have a genuine interest in avoiding fraud on our services, we gather certain information from and about the electronic device you are using to access our services. Your user ID, country domain, IP address, device language settings, device brand and type, device operating system and version, browser type and version, and device-specific software details like fonts, system and browser time zone, and available video and audio formats are among the data we gather, depending on whether you are logged in. When users engage with our services, the device-related data is used to ascertain if the same device is being used. We link this data to a user fraud score, which we use to decide which people to ban. Our staff will evaluate the decision to ban your account if you believe it was made incorrectly. You may reach us by calling our customer service hotline.

2.4. to solicit your opinions, advertise, and provide you with services that could be of interest

2.4.1. To get your opinion on our services, we could get in touch with you using the email address or registered cellphone number you provided.

2.4.2. To provide you with recommendations and ideas about our services that could be of interest to you, we utilise your email address and cellphone number (by WhatsApp Message).

2.4.3. Clickstream data is used to track and report campaign delivery performance to internal business analysts and business partners.

2.4.4. If you decide to provide us with your location information, we could use it to track and assess how you engage with the third-party ad banners that we display on our services.

We handle the aforementioned data because we have the right to engage in marketing initiatives to provide you with potentially useful services. In particular, we or our business partners may send you the following marketing communications:

• Using your chosen method of contact, if you have asked us for this information.

• By phone or email, if you currently use our services or have purchased some of our items, ask about comparable goods and services.

• By phone or email, if you gave us your information when you participated in a contest.

• If you signed up for a promotion via phone or email.

• By phone or email if you have expressed your opinions about our services via social media, our platform, or any other channel.

Please be aware that, as a registered user on our platform, you will continue to receive the aforementioned messages even if you have enrolled for DND/DNC/NCPR services.

By clicking the opt-out link in the email you received, adjusting your account's notification settings, or telling our calling agent that you do not want to be contacted for the aforementioned marketing communications, you can request that we cease sending you these communications at any time.

You consent to receiving an email at least once a year alerting you to the fact that NearByExpire.com and its policies may immediately terminate users' access or usage rights, remove non-compliant content, or both if they violate the Information Technology (Intermediaries Guidelines) Rules, 2011.

3. How will we let you know if our privacy statement changes?
